1. READ THESE TERMS CAREFULLY

These General Conditions will expressly regulate the relationships that arise between Esther García, C/ Virgen del Val 22, 28027 Madrid, Spain, and with NIF: 51671774C (hereinafter, “Animal Herbalist”) and third parties (hereinafter, “Users”). ) who register as users and/or purchase products through the online store of the official website of “Herbalist for Animals” (http://www.herbolariosoldeinvierno.es), hereinafter the “Store”.

2 OBLIGATIONS OF THE USER

2.1 The User undertakes, in general terms, to use the Store, to acquire the Products and to use each of the Store's services diligently, in accordance with the law, morality, public order and the provisions of these General Conditions, and must also refrain from using them in any way that could prevent, damage or deteriorate the normal functioning and enjoyment of the Store by the Users or that could injure or cause damage to the property and rights of “Herbolario para Animales” , its suppliers, Users or in general from any third party.

3. PRODUCTS AND PRICES

3.1 “Herbalist for animals” reserves the right to decide, at any time, the Products that are offered to Users through the Store. In particular, “Herbalist for animals” may at any time add new Products to those offered or included in the Store, it being understood that unless otherwise provided, such new Products will be governed by the provisions of these General Conditions. Likewise, “Herbolario para Animales” reserves the right to stop providing or facilitating access and use at any time and without prior notice of any of the different types of Products offered in the Store.

3.2 The Products included in the Store will correspond in the most reliable way possible that web display technology allows to the Products actually offered. The characteristics of the Products and their prices appear in the Store. The prices indicated in the Store are in Euros and include VAT.

4 PROCEDURE AND FORM OF PAYMENT OF THE PRODUCTS

4.1 Within a maximum period of twenty-four (24) hours, “Herbalist for Animals” will send an email to the User, confirming the purchase. Said email will assign a purchase reference code, and will detail the characteristics of the Product, its price, shipping costs and the data of the different options to make payment for the Products to “Herbalist for Animals”.

4.2 The User who purchases a product through the Store must make payment through the payment systems specifically detailed in the Store.

4.3 “Animal Herbalist” will archive the electronic documents in which the contract is formalized, sending a copy to the User once the purchase is made. The contract will be carried out in the Spanish language.

4.4 The order confirmation sent by “Animal Herbalist” is not valid as an invoice, only as proof of purchase. “Animal Herbalist” will send the corresponding purchase receipt along with the Product.

5. RIGHT TO RETURN AND EXCHANGE THE PRODUCTS

5.1 If the User is not satisfied with any of the products they have purchased from us, they may exchange or return the product to us within a period of 14 days following delivery of the products and obtain a refund of the price of the returned product within the maximum period. of 30 days. The cost of collection transportation will always be the responsibility of the client.

5.2 If the order arrives with any anomaly, the User must report it immediately upon receipt to the address: informacion@herbolariosoldeinvierno.es attaching photographs of the damaged product as proof of its condition.

5.3 To correctly return the products, the User will have to follow these guidelines:

•Products must be returned in their original box/packaging and in the same shipping box. If this is not possible, use a box of the same quality. Do not add tape, staples or others to the products or their packaging.

•The products cannot have been used in a way that reduces or impairs their value.

•The products must be accompanied by the delivery note with the reason for the return noted manually for correct and quick management of the return.

5.4. Upon arrival at our warehouse, the condition of the products will be assessed. If they do not comply with the regulations established for returns and their condition is not correct, we reserve the right to pay a lower amount for the damaged product or products.

5.5. At the end of the review of the products, the amount will be refunded through the same channel with which the payment was made or we will contact you to replace the affected products.

5.6. For refunds of payments by Paypal, if the refund is via Paypal, the two commissions that Paypal applies to businesses will be deducted, that is, for sales and for refunds. Alternatively, the amount may be returned to the buyer via bank transfer, applying only the commission that Paypal applies to the merchant.

6 CUSTOMER SERVICE

7 HOME DELIVERY SERVICE

7.1 The territorial scope of sales through the Store is exclusively for the territory of Spain, so the delivery service will only be for said territory. The Products purchased through the Store will be sent to the delivery address that the User indicates once payment has been verified, with the maximum delivery period being thirty (30) days established by default in the Law.

7.2 The “Herbalist for Animals” delivery service is carried out in collaboration with different logistics operators of recognized prestige. Orders will not be served at PO Boxes or at hotels or other non-permanent addresses.

7.3 The cost of shipping is not included in the price of the Products. At the time of purchase of the Product, the User will be informed of the exact shipping cost.

7.4 The shipping cost will be free for shipments to the Peninsula for an amount greater than 50 euros, only with TourlineExpress. Offer not applicable for shipments to the Balearic Islands, Ceuta, Melilla and the Canary Islands.

8. INTELLECTUAL AND INDUSTRIAL PROPERTY

8.1 The User acknowledges that all elements of the Store and each of the Products, the information and materials contained therein, the brands, the structure, selection, arrangement and presentation of their contents, and the computer programs used in relation to them, are protected by intellectual and industrial property rights of the “Herbolario para Animales” itself, or of third parties, and that the General Conditions do not attribute any other right other than those specifically with respect to said industrial and intellectual property rights. contemplated in them.

8.2 Unless authorized by “Herbalist for Animals” or, where applicable, by the third party holders of the corresponding rights, or unless this is legally permitted, the User may not reproduce, transform, modify, disassemble, reverse engineer, distribute, rent, lend, make available, or allow access to the public through any form of public communication of any of the elements referred to in the previous paragraph. The User must use the materials, elements and information accessed through the use of the Store solely for their own needs, agreeing not to carry out, directly or indirectly, commercial exploitation of the materials, elements and information obtained through the same.

8.3 The User must refrain from evading or manipulating any technical devices established by “Herbalist for Animals” or by third parties in the Store.

9 DATA PROTECTION 

9.1 In compliance with the provisions of Organic Law 15/1999, on the Protection of Personal Data, you are informed that completing any existing form on the page www.herbolariosoldeinvierno.es or sending an email to anyone of our accounts implies the acceptance of this privacy policy, as well as the authorization to Esther García Pérez to process the personal data that you provide us.

The user's data will be stored in a file owned by Esther García Pérez and will be used to manage your requests and to keep you informed of the services and news that are deemed to be of interest to you. New contacts can be made by regular mail or email.

The owner undertakes to maintain the maximum reserve and confidentiality of the information provided to her and to use it only for the indicated purposes. In no case will she transfer her personal data to third parties.

The owner understands that the data has been entered by the owner or by a person authorized by the owner, as well as that they are correct and exact.

10. PASSWORDS 

10.1 “Animal Herbalist” will facilitate the use of personal passwords to the user who registers as such on the website. These passwords will be used to access the services provided through the Website. The user must keep the passwords under their sole responsibility in the strictest and absolute confidentiality, assuming, therefore, any damages or consequences of any kind arising from the breach or disclosure of the secret. For security reasons, the password for telematic access to the services linked to the Website may be modified at any time by the user. The User agrees to notify “Herbolario para Animales” immediately of any unauthorized use of his or her password, as well as access to it by unauthorized third parties.

11.1 “Herbalist for Animals” uses cookies in order to improve its services, facilitate navigation, maintain security, verify the User's identity, facilitate access to personal preferences and track their use of the Store. Cookies are files installed on the computer's hard drive or in the browser's memory in the folder preconfigured by the operating system of the User's computer to identify them.

11.2 If the User does not want a cookie to be installed on their hard drive, they must configure their Internet browsing program to not receive them. In the event that the User decides to deactivate cookies, the quality and speed of the service may decrease and, even, they will lose access to some of the services offered in the Store.

12. APPLICABLE LAW AND JURISDICTION 

These general conditions are governed by Spanish legislation. Any controversy arising from the interpretation or execution that may arise in relation to the validity, interpretation, compliance or resolution of this contract will be submitted to the Jurisdiction and Competence of the Courts and Tribunals of the City of Madrid, waiving the jurisdiction that may correspond to the User, provided that the applicable legislation allows it.
